Animal Medicines Australia Limited ACN 116 948 344 (‘AMA’) is committed to protecting your privacy and any personal information we collect and complying with the Privacy Act 1988 (Cth) (‘Privacy Act’).

This document (‘Privacy Policy’) explains how AMA may collect, use, disclose and otherwise handle personal information.

 

ABOUT THIS PRIVACY POLICY

This Privacy Policy applies to AMA. AMA is an industry association representing animal health companies. We represent the interests of our members or the collective interests of our members on regulatory, policy and technical matters in the animal health sector.

 

WHAT IS PERSONAL INFORMATION?

‘Personal information’ is defined in the Privacy Act. Broadly, it means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether it is recorded in a material form or not.

‘Sensitive information’ is also defined in the Privacy Act. Broadly, sensitive information is a subset of personal information which is generally afforded a higher level of protection. It includes information or an opinion about an individual’s racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual orientation or practices, and criminal record. It also includes health information about an individual, genetic information about an individual that is not otherwise health information, biometric information that is to be used for the purpose of automated biometric verification or biometric identification, and biometric templates.

For the purposes of this Privacy Policy, references to ‘personal information’ means ‘personal information’ as defined in the Privacy Act, and includes ‘sensitive information’ (as defined in the Privacy Act).

 

WHY DOES AMA COLLECT MY PERSONAL INFORMATION?

AMA collects personal information primarily to enable it to provide products and services to its members. AMA may also use personal information for marketing or for any other purpose permitted under the Privacy Act.

 

AM I REQUIRED TO GIVE AMA PERSONAL INFORMATION?

You do not have to identify yourself or provide any personal information when you deal with us (e.g. to make an inquiry). However, in certain situations we will need to only deal with individuals who have identified themselves and provided certain personal information to us. Further, if the information provided to us is not accurate or complete, we may not be able to assist or deal with you.

 

WHAT PERSONAL INFORMATION DOES AMA COLLECT?

The personal information AMA collects and holds will depend on whether you are a member, employee of a member, consultant, employee, job applicant and/or which AMA products and services you have used or provide to AMA.

Information that we collect about AMA members may include (but is not limited to):

  • name, address, phone number, email and other contact details;
  • bank account, credit card and other payment details; and/or
  • username and password to access a member account.

Information that we collect about consultants and employees may include (but is not limited to):

  • name, address, phone number, email address and other contact details;
  • date of birth;
  • employment details;
  • education and professional qualifications;
  • bank account details; and/or
  • tax file number.

Information that we collect about job applicants may include (but is not limited to):

  • name, address, phone number, email address and other contact details;
  • date of birth;
  • employment details; and/or
  • education and professional qualifications.

We may also collect personal information of other individuals, such as representatives of third-party service providers, AMA officers and directors including (but not limited to):

  • name, address, phone number, email address and other contact details;
  • date of birth; and/or
  • education and professional qualifications.


HOW DOES AMA COLLECT PERSONAL INFORMATION?

AMA may collect personal information directly from you (in person, by phone, electronically or online) including (but not limited to) when:

  • you request information about AMA’s products or services, or the products or services of one of our business partners;
  • you apply to be a member of AMA;
  • you apply for employment with AMA or to provide a service to AMA; and/or
  • you visit our website.

AMA may also collect personal information from third parties about you, including (but not limited to):

  • other AMA members;
  • government agencies;
  • state registration boards and professional associations;
  • your employer or advisers;
  • financial or educational institutions;
  • publicly available records, including LinkedIn or other social media websites;
  • other companies who provide services to AMA, including (but not limited to) market research companies, webmasters and website administrators and psychometric testing service providers; and/or
  • personal referees or references.

These third parties may have their own privacy policies.

 

HOW DOES AMA USE PERSONAL INFORMATION?

If you are an AMA member, we may collect may collect, store, use and disclose personal information for any of the following purposes:

  • to provide regulatory, policy and technical advice and related services;
  • to determine eligibility for membership or to receive an AMA product or service;
  • to manage our relationship with you;
  • to promote and market AMA’s current and future products and services;
  • to promote and market existing and future other co-branded products and services, and products and services of our business partners;
  • to conduct research (including but not limited to surveys) concerning AMA’s current and future products and services, and develop new products and services for the benefit of members;
  • for record keeping purposes such as maintaining our register of members; and/or
  • to comply with our legal obligations.

If you are a consultant or employee we may collect, store, use and disclose personal information for any of the following purposes:

  • to assess your eligibility for employment opportunities at AMA;
  • manage our relationship with you;
  • pay you for the services you provide to AMA; and/or
  • to comply with our legal obligations.

If you are a job applicant, we may collect, store, use and disclose personal information for any of the following purposes:

  • to assess your suitability for employment opportunities at AMA;
  • to undertake background or reference checks to assess your eligibility for the position for which you applied;
  • to consider your eligibility for, and advise you of, suitable employment opportunities in the future; and/or
  • to comply with our legal obligations.

We may also collect, store, use and disclose personal information of other individuals, such as representatives of third party service providers, AMA officers and directors, for any of the following purposes:

  • to provide our products and services to you;
  • to receive products or services from you;
  • to administer our business;
  • to manage our relationship with you; and/or
  • to comply with applicable laws.

 

WILL MY PERSONAL INFORMATION BE DISCLOSED TO ANYONE ELSE?

AMA may disclose your personal information to:

  • persons employed or engaged by AMA (including AMA directors and officers);
  • any person or entity you have expressly authorised us to share your personal information with;
  • AMA’s contractors and service providers performing services including (but not limited to) marketing, market research, customer support services, mail-house services, hosting and product development services;
  • third party service provider information technology platforms (for example, to assist AMA in storing or accessing personal information you provide to us); and/or
  • AMA’s existing and future strategic partners in respect of co-branded products and services for marketing purposes.

AMA may also be required to disclose your personal information to individuals to whom you have granted authority to act on your behalf. For example, any powers of attorney, legal representatives or other persons you authorise.


Otherwise AMA may disclose your personal information to any third party:

  • if you authorise AMA to do so;
  • if your health and safety or that of others in the community is at risk;
  • if it is permitted under the Privacy Act to do so;
  • if AMA is required or authorised to do so by or under an Australian law or court/tribunal order; and/or
  • on a de-aggregated or de-identified basis.

Some of the entities to whom we disclose personal information may be located overseas, including (but not limited to) global and regional animal health associations.

 

AUTHORISATION OF DISCLOSURE TO THIRD PARTIES

You may authorise AMA to disclose your personal information to specific persons or entities (for example, to your family members or professional bodies of which you are a member) by notifying AMA of the name and contact details of those persons/entities which you consent to your personal information being disclosed to. This notification must be made in writing to AMA by letter signed by you or by way of email from you.

DIRECT MARKETING AND OPTING OUT

AMA uses and discloses your personal information to communicate with its members and potential members (e.g. by mail, telephone, email and/or sms) about current and new AMA products and services.

You can ask us at any time to stop sending you direct marketing from any particular channel or at all, by contacting AMA using the contact details below.

 

AMA WEBSITE AND COOKIE POLICY

In addition to any personal information you give to us via our website, such as when you complete an online form or submit other information or documentation to us online, the AMA website uses cookies to capture certain data about your internet activity.


For each visitor to the AMA website, AMA (or the webmaster or administrators of the website) may collect the following non-personally identifiable information including (but not limited to):

  • operating system
  • pages viewed while browsing the AMA site

AMA uses cookie data primarily for statistical purposes and to analyse website activity.

IS PERSONAL INFORMATION SECURE?

AMA takes reasonable steps to ensure your personal information is kept secure, and is not subject to misuse, interference and loss, unauthorised access, modification or disclosure. In particular:

  • We destroy or de-identify personal information we no longer need, wherever possible.
  • Any health records collected by AMA will be held in accordance with health records legislation in the relevant Australian State or Territory.
  • AMA uses encryption methods, such as the Secure Socket Layer (SSL) protocol, to further protect personal information that is transmitted electronically

Personal information collected by, or provided to, AMA may be stored on physical computer servers or storage devices or by using cloud-based storage facilities.

You acknowledge that the security of electronic methods of provision, storage and disclosure of personal information cannot be entirely guaranteed by AMA and may be out of AMA’s reasonable control. You accept the risks in relation to the electronic provision, use, storage and disclosure by AMA of your personal information.

 

HOW DO I OBTAIN ACCESS TO MY PERSONAL INFORMATION?

You can access your personal information that is held by AMA.

We will respond to your access request within a reasonable period. Please note:

  • We will need to verify your identity before we can provide you with access to any information.
  • There may be circumstances in which we cannot provide you with access in the manner requested or at all. If this happens, we will advise you in writing of our reasons and how you can complain about the decision.

You will not be charged for making an access request, however we may need to charge for the reasonable cost of processing your access request, including photocopying, administration and postage.

 

IS MY PERSONAL INFORMATION ACCURATE? CAN IT BE CORRECTED?

The accuracy of your personal information is important to us.

AMA will take reasonable steps to ensure your personal information is accurate, complete, up to date and not misleading, and also relevant for any purpose for which we use or disclose it. However, we rely on you to advise us of any changes to your contact details and any other personal information.

If you believe that any personal information AMA holds about you is inaccurate, incomplete, out of date, irrelevant or misleading, please advise AMA immediately using our contact details below.

If we are satisfied that your personal information needs to be corrected, we will take reasonable steps to do this. However there may be circumstances in which we may have to refuse a request for correction. We advise you of any refusal in writing and our reasons and how you can complain about our decision. In such a case you can also request that we associate a statement with that personal information that you believe should be corrected.

You will not be charged for making request for a correction or requesting us to associate a statement with your information.

AMA reserves the right to review, update and change this Privacy Policy from time to time to reflects our practices and obligations. Any changes will take effect when they are made and posted on our website.
